Terms of Use

OlaWell, a product of AFOLAOLA. Version 1. Status: review version. This document has not been put in force yet, and no effective date has been set. It describes how OlaWell works today.

1. Accepting these terms

These Terms of Use ("Terms") are an agreement between you and AFOLAOLA ("we", "us") about your use of OlaWell, including the website, the app and anything we provide with them. When you create an account, you confirm that you have read these Terms and the Privacy Policy and that you accept them. If you do not accept them, please do not create an account. We record which version you accepted and when.

2. Who can use OlaWell

OlaWell is for adults. You must be at least the age of majority where you live, and you must be able to enter into an agreement. You must give accurate account details and keep them up to date. Please do not use OlaWell for someone else's health information unless you have the right to do so, for example because you are helping a family member with their permission.

3. Your account and security

• Choose a strong password that you do not use elsewhere, and keep it private. We will never ask for your password.
• You are responsible for activity on your account. Tell us promptly at security@afolaola.com if you think someone else has access.
• Password reset by email works only when email delivery has been set up. If it is not available, keep your password somewhere safe. We may not be able to restore access to an account.

4. OlaWell is an organizer, not medical advice

OlaWell helps you record and organize information you add yourself and prepare for conversations with your healthcare professionals. It does not provide medical advice, diagnosis or treatment. It does not interpret your information, monitor you, or watch for emergencies. It is not a substitute for a qualified healthcare professional.

• Always ask a qualified healthcare professional about your health and treatment, and before you change or stop any care or medicine.
• Do not rely on OlaWell for urgent situations. If you think you may have a medical emergency, contact your local emergency services immediately.
• Reminders and notices in OlaWell are a convenience. They may be late, missed or wrong. Do not rely on them for anything where a missed reminder could harm you.
• Text produced by voice entry may contain mistakes, including in names of medicines, numbers, dates and times. You are responsible for checking it before you save it.

5. What you add

You keep all rights in the information and files you add ("Your Content"). You give us permission to store, process and display it only as needed to run OlaWell for you, as described in the Privacy Policy. You are responsible for Your Content, including making sure you have the right to add it and that it is accurate enough for your own purposes. Health information is sensitive. Add only what you are comfortable storing in an online service.

6. Acceptable use

Please do not:

• try to access another person's account or information, or to get around OlaWell's security, rate limits or access controls;
• test, scan or probe OlaWell for weaknesses without our written permission (to report a vulnerability responsibly, see section 12);
• upload malicious files, or anything unlawful, or anything you have no right to hold;
• overload or disrupt the service, or use automated tools to create accounts or collect data;
• copy, resell or build a competing service from OlaWell's design, text or code except as the law allows;
• use OlaWell in a way that is unlawful, or that could harm other people.

7. Privacy

Our Privacy Policy explains what we collect and how we use it. It is part of these Terms. If you have a question, email privacy@afolaola.com.

8. Third-party services

OlaWell runs on services supplied by others, such as hosting, database and email delivery, listed in the Privacy Policy. Your browser or device may also provide features OlaWell uses, such as installing the app or on-device speech recognition. Their own terms apply to what they provide, and we are not responsible for services we do not control. Links to other websites are provided for convenience.

9. Availability, maintenance and changes to the service

OlaWell is new. We try to keep it available but do not promise that it will be uninterrupted, error-free or that it will always be offered. We may update, change, limit or retire features, and we may take the service down for maintenance. If we plan to stop the service, we will give notice in the app or on our website where we reasonably can, so you have time to export your information. Keep your own copies by using Export from time to time.

10. Exports, closing your account and ending access

• You can export your information and delete your account at any time in Settings. What deletion does, and what remains in backups, is explained in the Privacy Policy.
• We may suspend or close an account if you seriously or repeatedly break these Terms, if we must do so to protect people or the service, or if the law requires it. Where it is reasonable and safe, we will tell you why and give you a chance to export your information first.

11. Our rights in OlaWell

OlaWell's name, logo, design, text and software belong to AFOLAOLA or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable permission to use OlaWell for its intended purpose while you follow these Terms. This does not give you ownership of any part of it. The AFOLAOLA and OlaWell names and logos may not be used without permission.

12. Reporting security problems

If you find a security weakness, please email security@afolaola.com with enough detail to reproduce it, and give us reasonable time to fix it before you share it. Please do not access, change or delete other people's information, and do not disrupt the service. We welcome good-faith reports and will treat them as help, not as an attack. This is not a legal safe harbour and we cannot promise how the law will treat any particular testing. We do not run a paid bug-bounty program.

13. No guarantees, and limits on our responsibility

OlaWell is provided "as is" and "as available". To the extent the law allows, we do not make promises about it beyond those in these Terms, including that it will suit a particular purpose, or be accurate, complete or secure from every threat.

To the extent the law allows, we are not responsible for indirect or consequential losses, or for loss that was not reasonably foreseeable, arising from your use of OlaWell. We are also not responsible for decisions you make about your health, which are for you and your healthcare professionals.

Nothing in these Terms excludes or limits anything that cannot lawfully be excluded or limited, including liability for fraud or deliberate wrongdoing, liability for death or personal injury caused by negligence where the law does not allow it to be excluded, and any rights you have under consumer-protection or privacy law where you live.

14. Governing law and disputes

Which laws and courts govern these Terms has not yet been confirmed by AFOLAOLA, and it will be stated here in a later version. Until then, nothing in these Terms limits any right you have to rely on the mandatory laws, or to bring a claim in the courts, of the place where you live. If you have a concern, please email legal@afolaola.com first, and we will try to resolve it with you in good faith.

15. Changes to these Terms

We may update these Terms. When we do, we update the version number below and show a notice in the app the next time you sign in, asking you to read and accept the new version. The notice does not block access to your own records or your export. If you do not agree to a new version, you can export your information and delete your account. We do not treat an existing account as having accepted a version it has not been shown.
